TERMS AND CONDITIONS
These Terms and Conditions set out the conditions relating to sale and purchase of our products on this website.
1. Application
By placing an order for Best Buy Design Limited products, you agree on your own behalf, and on behalf of each entity on whose behalf you act, to these Terms and Conditions.
2. Interpretation
In these Terms and Conditions:
"We", "us", "our" means Best Buy Design Limited
"You", "your" means the person ordering products under these Terms and Conditions
"Working days" means all days other than Saturdays, Sundays and Public Holidays.
"Product" means the product or products you have ordered from us.
3. Agreement
Your order represents an offer to us to purchase the goods which is accepted by us when we send you an e-mail confirming acceptance of your order. A legally binding contract between us is created at the point of our acceptance of your order.
We have the sole and absolute discretion not to accept your order for any reason or limit the quantities of certain products which you purchase through this website and will not be liable to you or anyone else in those circumstances.
In order to purchase through this website, you have to be aged 18 years or older and you agree to pay for all charges noted on this website as payable by you.
The supply of products is subject to availability.
4. Prices and Payment
We accept all major credit cards, or you can choose to use PayPal for your purchase.
The prices for products displayed for sale on this website are as set out on the website. All prices are in US Dollars, delivery will be charged in addition.
Prices may change at any time prior to (but not after) acceptance of your order.
In the unlikely event that the price of a product has been incorrectly advertised on this website, we will contact you by e-mail (at the address provided with your order details) or telephone you, to ask whether you wish to proceed with the order at the correct price. If you are not happy to proceed, or we are unable to obtain your instructions, we will cancel the order and provide you with a full refund of any monies debited.
By using a credit card to pay for your order, you confirm that the card being used is yours. All credit card holders are subject to validation checks and authorization by the card issuer. If the issuer of your card refuses to authorize payment, we will not accept your order and we will not be liable for any delay or non-delivery and we are not obliged to inform you of the reason for the refusal. We are not responsible for your card issuer or bank charging you as a result of our processing of your credit card payment in accordance with your order.
5. Delivery
Subject to availability, we will use our reasonable endeavours to ship out the products you have ordered within 14 working days of your placing the order, but we cannot accept any liability for late deliveries which are due to circumstances beyond our reasonable control. We will deliver the products direct to the address you specify when you submit your order.
If the products you order are not available, for whatever reason, we will inform you of the position by e-mail (at the address provided with your order details) or telephone. If the products are temporarily out of stock, we will ask if you wish to wait for the products to become available. If you advise us of your wish for a refund, we will refund any money debited from your payment card by re-crediting your account. The refund will be made as soon as possible and in any case, within 28 days of notifying you of the non-availability of the products.
Occasionally, products may be returned to us as undeliverable. When the carrier returns an undeliverable package to us, we issue a full refund. We will not re-deliver orders that are returned to us as undeliverable. If you would still like to purchase products that were undeliverable, you are welcome to place a new order on our website.
When placing an order, you should ensure that the address to which the purchase is delivered is correct. We cannot deliver to a PO Box address. Certain deliveries must be signed for.
To send gifts to multiple locations, each order has to be placed separately. We are unable to deliver to multiple locations in a single checkout.
Once delivered, the products will become your property (provided they have been paid for in full) and we will not accept any liability for their loss, damage or destruction after they have been delivered.
6. Customs
When you are ordering our products which need to be delivered outside the United States, you may be subject to import duties and taxes which are levied once the package reaches the specified destination. Any additional charges for custom clearance must be borne by you; we have no control over these charges and cannot predict what they may be.
7. Cancellation of Order
You may cancel your order (or any part of it) at any time before we accept your order for the products by e-mailing us at vino-sales@bestbuydesign.biz.
8. Faulty or Damaged Products
We will replace or offer a full refund for faulty products or products damaged in transit.
In the event that you wish to return faulty or damaged products to us, you should e-mail us at
vino-sales@bestbuydesign.biz within seven days of receipt of the products and return your purchase for a refund or exchange with proof of purchase within fourteen days of your purchase. Items returned to us should be sent to the address shown in Section 17 below.
We are unable to accept returns of products purchased through this website unless they are faulty or damaged.
9. Limitation of Liability
We will not be liable to you for any loss of profit, administrative inconvenience, disappointment, or indirect or consequential loss or damage arising out of any problem in relation to the products you ordered which was not within our reasonable contemplation as a probable result of a breach of contract on our part at the time that our contract with you was concluded.
Likewise, we will not be liable to you where performance of any obligations to you is prevented, frustrated or impeded by any circumstance or cause beyond our reasonable control.
This website and its contents are provided "as is" and we make no representations or warranties of any kind with respect to it. We assume no liability or responsibility for any errors or omissions in the content of this website and disclaim all representations and warranties, including, for example, warranties of merchantability, fitness for a particular purpose, and non-infringement. In addition, we do not represent or warrant that the information accessible via this website is accurate, complete or current.
We do not exclude or limit our liability for death or personal injury caused by our negligence.
10. Severability
If any part of these Terms and Conditions is found to be unenforceable as a matter of law, the enforceability of any other part of these Terms and Conditions will not be affected.
11. Amendment to the Terms and Conditions
We may change these Terms and Conditions at any time, provided that any such change will not affect any purchase you have made before the change is implemented. The Terms and Conditions currently in effect are those published on this website.
12. Assignment of Contract
This contract is personal to you and your rights and obligations under these Terms and Conditions may not be assigned, sub-licensed or otherwise transferred. The contract may be assigned by us to a third party.
13. Complaints
We aim to provide outstanding customer service. If you have any complaint about the services received from us, please e-mail our Customer Service Team at vino-customer@bestbuydesign.biz.
14. Privacy
We collect personal information about you through your use of this website and our services. All information that we collect about you is subject to our Privacy Policy which forms part of these Terms and Conditions.
15. Entire Agreement
Save as expressly referred to herein, any representation, warranty, term or condition not expressly set out in these Terms and Conditions shall not apply.
16. Governing law and jurisdiction
These Terms and Conditions are governed and construed in accordance with the laws of Hong Kong Special Administrative Region. You agree, as we do, to submit to the exclusive jurisdiction of the Hong Kong courts.
17. General
Unless otherwise stated, all sizes, dimensions and capacities stated in this website are approximate.

SHIPPING POLICY
Our goal is to process and ship your order out within 14 working days of receipt of your order. For US addresses, USPS Priority Mail from Hawaii takes 3 - 5 working days. If you specifically request UPS Next Day service, or have orders of 6 or more wine cases please contact us at vino-sales@bestbuydesign.biz.
For delivery outside the U.S., we will email you the Postal Rate. You are required to pay local Customs Fees and Taxes charged by the country of import upon delivery. Please place your order by emailing us at vino-sales@bestbuydesign.biz.
If you do not receive our e-mail within 5 days of placing your order confirming acceptance of your offer for the purchase of our Vino Vitula wine cases, please contact us at vino-sales@bestbuydesign.biz
RETURNS POLICY
Vino Vitula wine cases which are faulty or damaged in transit may be returned to us for exchange or a full refund. Please notify us at vino-sales@bestbuydesign.biz within 14 days of receipt and return it within 30 days, unused and in its original condition (tags attached, etc.), with proof of purchase to 2338 Halehaka Street, Honolulu, Hawaii 96821.
SALES TAX
Sales Tax : 4.712% Hawaii General Excise Tax on Vino Vitula wine cases shipped to a local address in Hawaii.
PRIVACY POLICY
We value and respect the privacy of our customers. Accordingly, no information collected by us on this website will be disclosed to anyone except as permitted by law.
We will not collect any personal information (such as your name, email address, mailing address, and telephone and credit card details) about you, except where it is specifically and knowingly provided by you, for example, when you place an order for our products.
When personal information is collected, it may be used by us to corroborate your identity and to enable us to provide you with the services we offer through this website and to process and fulfill orders or requests for information or advice as well as to further develop this website to be useful to you and enable us to provide further services on this website in the future.
